Marijuana to West Street

Attorneys have inquired of Town of Medfield officials about their clients’ plans to open a marijuana cultivation facility at 99 West Street.  From the attorney’s email to the town official –

“As of now their plan is to put a cultivation center only at that location.

“There would be no signage and the outside of the building would look almost identical to its existing face.  Our clients are well funded Mass. residents that run multi-million dollar private equity firms.”

  1. So, we’re supposed to be happier about this because their clients are well funded MA residents running multi-million dollar private equity firms? Shaking my head in disbelief.

I am curious if they can put this in so close to that 40b complex. Lots of activity down there. I thought, too, that we as a town had to approve having such a facility – zoning and all. Hasn’t Needham taken a postponed approach until they understood the meanings of the law.

      Errin,
I do not think that the proximity of the 40B should not play into it.

The town passed a zoning ordinance that makes the marijuana facilities a use that is permitted upon the granting of a special permit, and I believe it was allowed in the Industrial Extensive zoning district, which is where this is proposed. So the town would have some say over the terms of the use, but not the ability to prohibit the use. Once the voters passed the ballot initiative permitting medical marijuana uses, the town cannot defend an absolute prohibition.

Some towns did enact a moratorium for a year on marijuana facilities – Medfield did not opt to do so.
